Technically and legally correct, perhaps.. but by NOT having a report taken
at the scene, particularly when the guilty party is either ready to admit
guilt (as was the case in my case), or at least tell an "honest story" so
that the report can properly reflect what happened.. the innocent party
becomes exposed to a "he said/she said" scenario the next day when the
story suddenly changes, and the guilty party claims that something entirely
different happened than what actually transpired.  This girl could have
tried saying that *I* merged into her, was doing 25 mph thus causing her
to lose control behind me, etc., and it would have been my word against
hers, the the insurance companies might easily have wound up "splitting 
the baby" leaving me 50% "at fault" or more.  Fuk 'dat, I'll hang around
for a report in any similar scenario!
