Legal options on gas tank recall



I had checked with VW 8 years ago and my car has NOT had the recall
performed. Tank
didn't leak then but it now leaks. But it does not appear to be leaking from
a "hair line crack adjacent
to the seam weld" at the rear of the tank. It appears to be leaking from the
top and front
of the tank likely due to corrosion.   Legally speaking, are they required
to change my
tank? I am guessing not since it doesn't appear to match the recall
conditions yet I think I can
prove that it is an original (bad) tank.  Is it worth the hassle trying to
find a sympathetic dealer in Ontario to
replace it for free or will they balk when they find it leaking from the
wrong spot? Thanks guys,
